Terms of Service
Who this is between
These terms are between EngiGrow, operating as Acadengine, and the school that signs up to use it. A parent, teacher or student uses the product as a user authorised by the school, under the school's own agreement with us — not as a separate party to this contract.
What we provide
Access to the software described on this site — attendance, marks, fees, bus tracking, communication and the related parent, teacher and headmaster portals — for the school's own students, staff and families, in exchange for the subscription fee agreed separately.
The school's responsibilities
- Obtaining valid consent from parents or guardians before their child's data is entered into the system — the in-app consent screen supports this but does not replace the school's own obligation to have a lawful basis for giving us the data in the first place.
- Keeping staff login credentials confidential and reporting a suspected compromise promptly.
- Using the product for the school's own legitimate educational and administrative purposes.
- Not attempting to access another school's data, or circumvent the access controls that keep schools separated.
Our responsibilities
- Operating the service with reasonable care, and working to keep it available.
- Processing data only on the school's instructions, as described in the Privacy Policy and the Data Processing Agreement.
- Notifying the school promptly of any data breach affecting their data — see our breach notification commitment in the Data Processing Agreement.
- Not accessing a school's data except to provide support the school has requested, or where the law requires it.
Data ownership
The school's data belongs to the school. We are a processor, not an owner. A school can request a full export of their data at any time, and will receive one automatically if their account is closed.
If a subscription ends
On cancellation or non-payment, access to the portals is suspended but data is not immediately deleted. The school (or its designated administrator) can request a full export during this window. After a reasonable retention period following account closure — intended to allow for a billing dispute or a change of mind, and to be fixed precisely in the Data Retention Policy — the school's data is permanently deleted from active systems and from backups as they age out.
Availability
We aim for the service to be available when a school needs it, particularly during the school day, but do not guarantee uninterrupted access. Planned maintenance is scheduled outside school hours where practical.
Limitation of liability
The product is provided on an “as is” basis. To the extent permitted by law, EngiGrow is not liable for indirect or consequential loss arising from use of the product. Nothing here limits liability for data breaches arising from our own negligence, or for anything that cannot be excluded under Indian law.
Changes to these terms
We will notify a school's administrator of a material change before it takes effect.
Governing law
These terms are governed by the laws of India.
